Agenda Item No. 1 - Approval of Ordinance 2021-564 amending Article IV Utilities in Chapter 58 includes reference to Overlay Districts and adds GMA model aesthetic standards to the small cell facilities ordinance.

The Planning Department seeks to amend Chapter 58, Article IV ‘Utilities,’ Division 2. Small Cell Wireless Facilities Ordinance to acknowledge zoning areas such as Overlay Districts and add reasonable aesthetic standards of Small Cell Wireless Facilities authorized by O.C.G.A. 32-4-92(a)(10)/32-4-42(6). Small Wireless Facilities refers to technologies at fixed locations designed to enable communication between user equipment and a communications network, typically at higher speeds. The ordinance (#2019-546), adopted January 2020, provided the purpose, definitions, permitted uses, permit application process, fees, and guidelines for removal, relocation, replacement, or abandonment of Small Wireless Facilities and support structures in the public right of way.  GMA provided supplemental aesthetic standards which apply to residential areas and historic districts.  The text amendments proposed to extend the aesthetic standards to Overlay Districts to ensure uniformity in color, design/material, and height.

Agenda Item No. 2 - Authorization for city staff to perform billing and collection services for ad valorem property taxes, streetlight, and solid waste fees

The Gwinnett County Tax Commissioner provides billing and collection services on behalf of the City of Lilburn for ad valorem property taxes, streetlight special assessment, and solid waste fees. Our existing contract expired upon the expiration of Mr. Richard Steele’s term as Tax Commissioner, and the new Tax Commissioner proposes changes to the contract to include an additional $1.75 per parcel commission for services provided to interested cities. As you are aware, SB201 was amended on the final days of the 2021 Georgia legislative session to remove the Tax Commissioner’s authority to charge cities the commission. However, the bill allows the county to pay the Tax Commissioner an additional amount for services to cities. Should the county choose to pay an additional amount, it is reasonable to assume the additional cost will be passed on to the cities. We believe that it is in the best interest of the city to perform our own property tax billing services effective this year.
